A CHARTER ORDINANCE CONFORMING WITH THE ADOPTED CITY CODE ESTABLISHING THAT THE GOVERNING BODY HAVE THE AUTHORITY TO HIRE AND TERMINATE EMPLOYEES OF THE CITY OF THAYER, KANSAS WITHOUT NOTICE AND HEARING PURSUANT TO ARTICLE 3, SECTION 1-302 REPEALING ANY PREVIOUS ORDINANCE OR CODE THAT STATES OTHERWISE
BE IT ORDAINED by the Governing Body of the City of THAYER, Kansas:
Section 1. The City of Thayer, Kansas, by the power vested in it by Article 12, Section 5 of the Kansas Constitution hereby elects to and does exempt itself and make inapplicable to it the provisions of K.S.A. 15-301 that allow the Mayor the ability to hire and terminate City personnel under their general powers of supervision of the City. All other powers mentioned shall survive.
Section 2. The governing body shall have general supervision of City employees including the ability to hire and terminate City employees when deemed necessary by a majority vote.
Section 3. The City Code in Article 3, Section 1-303 (d), that states no "employees shall be removed for any reason until he or she has been given notice and afforded the opportunity for a hearing" shall be amended to read as follows removing the notice and hearing requirement as City employees are considered "at-will" employees:
Article 3., Section 1-303 (d) No officer should be removed or not re-appointed until he or she has been given notice and afforded the opportunity for a hearing showing cause.
