(a)   Except as provided in subsection (b) it shall be unlawful for any person to operate an all-terrain vehicle on any interstate highway, federal highway, state highway or city streets.

(b)   Notwithstanding the provisions of subsection (a), all-terrain vehicles owned and operated by a country noxious weed department, or all-terrain vehicles owned and operated by persons contracting with a county noxious weed department or the Kansas Department of Transportation may be allowed to operate such all-terrain vehicles upon the right-of-way of any federal highway or state highway for the purpose of eradicating noxious weeds and such all-terrain vehicles may be operated incidentally upon such federal highway or state highway.

(a)   The City of Thayer, being a city of the third class, hereby authorizes the use of either four-wheel or six-wheel all-terrain vehicles on the city streets within the corporate limits of the city, with exceptions.

(b)   No all-terrain vehicle shall be operated without a permit duly authorized by the City of Thayer.

(c)   No all-terrain vehicle shall be operated within the city limits on any city street or road between sunset and sunrise unless equipped with lights as required by law for motorcycles.

(d)   Permits for the operation of an all-terrain vehicle may be purchased at the Thayer City Offices. Applicants must be 18 years old or older to purchase a permit. The cost for such permit shall be $10.00 per year and shall be valid for one year from January 1 to December 31st of each year. Permits for the year 2007 shall be prorated to $5.00.

(e)   All such permits for the operation of an all-terrain vehicle must be attached to the left front fender of such all-terrain vehicle and be clearly visible.

(f)   Any person fifteen (15) years of age and under operating an all-terrain vehicle and be clearly visible.

(g)   Failure to obtain (g) Failure to obtain a permit properly displayed, or operate without a helmet or operate without proper lights, shall be constituted as a traffic violation through the Thayer Municipal Court and shall result in a fine in the amount from $25.00 to $500.00, plus court costs. Additionally the Municipal Judge may restrict or suspend permits.

The purchasing of permits as set forth in section 14-202 shall be exempt only during the times of the Homecoming parade and the All-terrain rodeo.
